Permits
The building industry is covered by legal and regulatory regimes so be familiar with these requirements before you hire anyone to start work on your home.

Permits

If you are considering a building project or renovation work on your home, contact your council and establish what permits and approvals are required and the procedures for obtaining them. You may need to lodge a Development Application, depending on the size and nature of the work and its environmental impact.

The work you are intending may be exempt from council consent because the council has already determined, and the community has agreed, that this work will have minimal or no impact on neighbours (such as some fences or garden sheds).  Or it may be a 'complying development' which still requires consent but can be fast tracked through the approval process.

Construction Certificate

If your development proposal involves building or subdivision work, you also need to obtain a construction certificate for the building plans, specifications or engineering drawings. You will to appoint a principal certifying authority to oversee the construction process (the council has officers who can act as this authority or you can appoint a qualified individual).

If you development is deemed to need approvals from other agencies (such as heritage, infrastructure and planning, or environment and conservation) it's y

our responsibility to identify them when you lodge your development application.
So it's essential to consult the council planning department and any other relevant government agency before you lodge a development application.

Owner-Builder requirements

In NSW anyone undertaking a building project or renovations costing more than $12,000 is required to hold an owner-builder permit which can be obtained only after completing an approved educational course or training. Check whether your State has a similar requirement.
